1. Taiwan EPA Published for HCFCs consumption management regulations

    Taiwan Environmental Protection Administration (EPA) have Published in 2007-05-04 for the revised Montreal Protocol regulations on HCFCs consumption. This Regulation is formulated pursuant to the provisions of Paragraph 2, Article 30, of the Air Pollution Control Act.


    The national consumption baseline level of HCFCs is set at 638 ODP tons. And the HCFCs consumption reduction agenda to the baseline level for each year are listed as follows:

    • For the twelve-month period commencing on 1st January 2004, and in each twelve-month period thereafter, the calculated level of consumption of HCFCs shall not exceed 65% of the baseline consumption level.
    • For the twelve-month period commencing on 1st January 2010, and in each twelve-month period thereafter, the calculated level of consumption of HCFCs shall not exceed 35% of the baseline consumption level.
    • For the twelve-month period commencing on 1st January 2015, and in each twelve-month period thereafter, the calculated level of consumption of HCFCs shall not exceed 10% of the baseline consumption level.
    • For the twelve-month period commencing on 1st January 2020, and in each twelve-month period thereafter, the calculated level of consumption of HCFCs shall not 0.5% of the baseline consumption level.
    • For the twelve-month period commencing on 1st January 2030, and in each twelve-month period thereafter, the calculated level of consumption of HCFCs shall not exceed zero.

    The regulation also defined the HCFC-141b used period, which include HCFCs as foaming agent in manufacturing of soft and semi-rigid polyurethane foaming plastic, non-insulation purpose polyurethane foam plastic etc. Infringement of the regulation could lead to a maximum fine of 1 million NT dollars, and continuous infringements or situation regarded as serious could lead to the suspension of business operating license.


  2. Taiwan EPA Published for Montreal protocol regulations on ozone depleting substances

    Taiwan EPA have been following the Montreal protocol since 1983 to reduce the ODS consumptions with the others developed country. There are a lot of related regulations be published in Taiwan, which are HCFCs consumption and methyl bromide uses management regulations. Taiwan EPA also forbid the production of CFC, Halons and CCl4.


    In order to strength the ODS reduction emissions. Taiwan EPA have Published in 2007-05-04 for the revised Montreal Protocol regulations on ozone depleting (ODS) substances, seeking opinions and comments from private sectors to the ‘regulation on controlled substances to the Montreal Protocol. The prior is an integrated set of rules on CFCs, Halons and other ODS announced before 2003. This regulation combined the previous rules and formulated pursuant to the provisions of Paragraph 2, Article 30, of the Air Pollution Control Act.


    The main changes to the ' regulation on controlled substances to the Montreal Protocol ' were: person that handling, refilling and dismantling equipment with controlled substances must adopt recovering facility, servicing of refrigeration and air-conditioning system can only use the recovered substances after 2010-01-01, and any intended discharge of substance to the atmosphere will be deemed as air polluting act. Infringement of the regulation could lead to a maximum fine of 1 million NT dollars, and continuous infringements or situation regarded as serious could lead to the suspension of business operating license.


  3. Taiwan EPA approved the second half year HCFC quotas for the uses

    Taiwan Environmental Protection Administration (EPA) convened two HCFCs quota allocation meetings in 2007-04-27, inviting importers and users to participate, confirming the consumption data submitted for their first half year of 2007 and approve the actual annual HCFCs quota allocation, and the projected purchase volume of the second half year for the current year of each applicant. amount applied for the second half year of 2007. There were 88 users and 11 suppliers that submitted their applications this year, and the total HCFCs demand estimated to be around 390 ODP tonnes in 2007. Compared to past years actual issuing figures, the number of users was reduced by 10. It means the demand of HCFC is decreased in the market.


    Taiwan’s national calculated consumption of HCFCs in 1996 was around 638 ODP tones, which was set as the baseline level for reduction. By 2004, the consumption level was around 383 ODP tons, which showed a 40% reduction from the baseline level, and it has been maintained at this level since. The import licensing system was recognized as an important measure for HCFCs consumption reduction. It show that the consumer will be use HCFC decreasing.


  4. Taiwan EPA approved the second half year methyl bromide quotas for the uses

    The methyl bromide consumption of non-Article 5 countries should have been completely phased out in 2005, but its actual uses for Quarantine and Pre-Shipment (QPS) purposes were exempted from such national consumption calculation. The increase in quantity for these purposes in the recent years has alarmed many parties to the Montreal Protocol. The Meeting of the parties came up with a decision to form a special task force to conduct a survey in details of such uses, and to assess the opportunity and feasibility of replacing them.


    There was no methyl bromide production capacity in Taiwan, the acquisition of the substance has to rely on import. According to the managing rules amended in 2003, only uses for quarantine and pre-shipment applications are allowed. Entities that qualify can submit their application and documentation to receive methyl bromide quota and import permits. However, the application form only requested applicants to fill in figures in brief categories of QPS uses, which has made it difficult to conform to the monitoring and records keeping requirements specified in Decision XI/13.


    With this regard, Taiwan EPA has approved the second half year methyl bromide quotas for the uses in 2007- 06-04.The total quantity of Quarantine & Pre-Shipment, QPS , is 120 thousand pound which come from 74 thousand pound for 98% purity and 46 thousand pound for 100% purity.


    There was only 1 importer for methyl bromide importing in the past. The monopolize the market situation happen very often. Taiwan EPA invited related government department to study how to avoid it. Based on the Mainland China is the Montreal protocol party, Taiwan EPA permit importing the methyl bromide from mainland china in 2006-05-03.Right now, There are 5 importers that to do it, and balance the market for QPS.


  5. Taiwan EPA creative a HCFC quota e-application system

    Following the e-government police from Executive Yuan, Taiwan EPA will promote the HCFC quota management system to be a non-paper process. The e-application draft system has been setup in web which is http://www.saveoursky.org.tw/index2.htm. ITRI designed and will maintain the system. In order to get more information about the system, an ITRI designer visit the relative companies to discuss how to improve the system, starting May 2007. The first phase of such visits has taken place already. These included the makers of household appliances, air condition facility companies, maintenances facilities and suppliers. ITRI will continue the visit schedule expand to other relative users. They hope to get more information to improve the system.
