1. Ozone-Depleting Substance Consumption in Taiwan in 2019

    Adhering to the Montreal Protocol, the Taiwan government has been calculating and reporting ozone-depleting substance (ODS) consumption data since 1992. According to Taiwan’s ODS consumption record, CFCs consumption has been reduced to zero and HCFCs consumption has been decreasing since 1996. The HCFCs consumption baseline was counted and set at 638.156 ODP metric tons in 1996. The HCFCs consumption was reduced to 65% of the HCFCs consumption baseline (382.51 ODP metric tons) in 2004 and 25% (152.56 ODP metric tons) in 2010, and 10% (63.8156 ODP metric tons) in 2015, respectively. As Taiwan abides by the Montreal Protocol's control measures, the HCFCs consumption in 2019 was reduced to 63.119 ODP metric tons, 0.68 ODP metric tons less than it was in 2019. The consumption is still kept below the control measure’s limit 10% of the baseline. The historical data of HCFCs consumption is shown in Figure 1.

    Taiwan endeavors to fulfill its own reduction commitments based on the Montreal Protocol by executing the HCFCs regulations and gradually suspending specific applications for using HCFCs, including the ban of using HCFCs on spray propellant and foam blowing, the use of HCFC-141b on solvent cleaning, the use of HCFC-22 as refrigerants for producing new air conditioners and refrigeration. For abiding by the 2020’s control measure and reducing our consumption below 0.5% of baseline, HCFCs would also not be allowed to be used for solvent cleaning and only could be used for service.

    Producers of ODS in Taiwan ceased the production of CFCs in 1996 and that of HCFCs in 2006. In 2019, the imported HCFCs were less than the previous year, consisting of 56.497 ODP metric tons of HCFC-22, 6.520 ODP metric tons of HCFC-123, 0.096 ODP metric tons of HCFC-124 and 0.025 ODP metric tons of HCFC-225. Exported HCFCs consisted of 0.660 ODP metric tons of HCFC-22.

    Methyl bromide has only been allowed to be imported for QPS purposes in Taiwan since 1999. In 2019, the amount of imported methyl bromide was 12.616 ODP metric tons; it was 20.276 metric tons less than in 2018. The importation data of methyl bromide is shown in Figure 2.

  2. Taiwan EPA Finalizes Quota Allocations for Methyl Bromide in QPS Applications for the First Half of 2021

    According to the regulatory norms of the Montreal Protocol, the consumption amount of methyl bromide had been reduced to zero as of 2005 in developed countries, and as of 2015 in developing countries. However, the amount of methyl bromide used for quarantine and pre-shipment (QPS) is not included in the consumption amount. At present, most countries can still produce and import methyl bromide for QPS purposes, except members of the EU, which stopped the use of methyl bromide for QPS on March 18, 2010.

    In response to international regulatory requirements, the Taiwan EPA published its Regulations for Management of Methyl Bromide (methyl bromide regulations) in 2003 to control QPS applications and the import of methyl bromide. Based on Articles 5 and 10 of the methyl bromide regulations, importers and users for QPS purposes shall apply to the central competent authority for importation and use their permits by the end of February each year, by estimating the amount needed for the first half of the calendar year. The same process shall be carried out by the end of each August for the first half of the following calendar year, with related documents attached.

    The Taiwan EPA convened with experts on October 13, 2020 to review and examine documents from applicants related to issuing methyl bromide use and import permits. The issued permits were calculated based on the amount of application quantity, usage and reasonable inventory (10% of usage) in the same period of the previous year, and then a reduction of up to 10% was applied for each discrepancy found by auditors. According to the results for the first half of 2021, there were 4,222.2 kg of 98% methyl bromide allocated for nine users and 3,600 kg of 100% methyl bromide allocated for the Keelung Branch and Hsinchu Branch of the Bureau of Animal and Plant Health Inspection and Quarantine (BAPHIQ).   3. Taiwan EPA Finalizes HCFCs Quota Allocations for 2021

    According to the Montreal Protocol and Regulations for Management of HCFCs Consumption, the allowable annual allocation for HCFCs from 2020 to 2029 is set at 3,191 ODP kg, which is 0.5% of the national consumption baseline (638,156 ODP kg), and should only be used for equipment maintenance.

    As specified in Article 9, the government can set a reserve of 10% for military and other national emergencies. The quotas for each user and supplier was calculated according to the declared corroborating data and reviewed in light of the examining principles adopted by the committee.

    According to the declared data from the users, the number of qualified users was 16, and qualified suppliers was 11. The quotas allocations for 2021 were calculated according to the quota allocation and usage data in 2020 of each user and supplier. The allocations quota for 2021 was divided into the first and second half of the year, and each user and supplier are allowed to adjust the ratio of the first and second half of the year according to their needs.

    The Taiwan EPA announced the HCFCs quota allocation on October 27, 2020. With four users willing to abandon their quota, and two users and one supplier got zero quota, the total HCFCs quota allocations in 2021 are 2,841.7170 ODP kg, of which 46% (1,311.2815 ODP kg) were allocated to 10 users; 54% (1,530.4355 ODP kg) were allocated to 10 suppliers.

    The allocations for 2021 have been completed. Users and suppliers should comply with the Regulations for Management of HCFC Consumption. The entrusted import should be done on the basis of the allocated quantity and types, and the first half of the quotas should be imported before June 30, 2021. According to Article 68 of the Air Pollution Control Act, the allocated quotas should not be resold or sold. The offender shall be fined NT$100,000 to NT$2 million, and may be forced to suspend operations under serious circumstance. Moreover, a false declaration is criminally liable, and the offender shall be punished under Article 71-1 of the Commercial Accounting Act.
